Refunds

Refund policies vary by service type and are outlined in your specific service agreement. Generally, fees paid are non-refundable except as required by law or as explicitly stated in your agreement.

6. Acceptable Use Policy

You agree not to use our services for any unlawful or prohibited purpose. Prohibited activities include but are not limited to:

  • Violation of intellectual property rights
  • Transmission of malware or harmful code

Violation of this policy may result in immediate suspension or termination of your account and legal action.

You are granted a limited, non-exclusive, non-transferable license to access and use our services for their intended purpose. You may not:

  • Reverse engineer or decompile our software
  • Remove or alter any proprietary notices

10. Limitation of Liability

To the maximum extent permitted by law, Fhs Payments Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from:

  • Your use or inability to use our services
  • Unauthorized access to your account or data
  • Errors, bugs, or interruptions in service
  • Third-party actions or content

Our total liability for any claim arising from these terms or our services shall not exceed the amount you paid to us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fhs Payments Inc. and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of our services
  • Your violation of these terms
  • Your violation of any laws or third-party rights
  • Your negligence or willful misconduct

12. Termination

Termination by You

You may terminate your account at any time by contacting us at contact@fasthubpay.mom. Termination does not relieve you of obligations to pay any outstanding fees.

Termination by Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activities
  • Fail to pay required fees
  • Pose a security risk to our systems or other users

Effect of Termination

Upon termination, your right to use our services ceases immediately. We may delete your account data in accordance with our data retention policies. Provisions that by their nature should survive termination shall remain in effect.

13. Dispute Resolution

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Arbitration

Any dispute arising from these terms or our services shall be resolved through binding arbitration in accordance with the rules of the ADR Institute of Canada, conducted in English in Ontario, Canada.

Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will provide notice of material changes by:

You may not assign or transfer these terms or your account without our written consent. We may assign these terms to any affiliate or successor without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions.
